On June 13th 2022 at about 9:40 AM, a Worcester Police Department sergeant was on patrol in the area of Ellsworth and Millbury St. The sergeant observed Axel Hernandez, twenty-one-years-old of Constitution Ave, walk toward a vehicle and enter the passenger’s side. The sergeant knew that Mr. Hernandez had an active warrant for his arrest. The officer called for backup and officers pulled up to the vehicle when it had stopped at a red light at Francis J McGrath Blvd and Myrtle St.

Multiple cruisers approached the vehicle and gave verbal commands for the driver to stop. The driver shifted the vehicle from drive into reverse and began backing toward the officers. Officers commanded the occupants to stop the vehicle and show their hands. They observed Mr. Hernandez moving around in the passenger compartment, leaning forward, and reaching toward the floor of the vehicle.

Eventually, the driver stopped the vehicle and placed it in park. Officers removed the occupants and attempted to place Mr. Hernandez in handcuffs. Mr. Hernandez tensed up, and attempted to pull away from the officers. He took both of his hands and grabbed the handle of an officer’s firearm. He rocked back and forth and attempted to pull the firearm from the officer’s holster. Officers removed Mr. Hernandez’s hands from the firearm and were able to take him to the ground. He continued to struggle and was placed in handcuffs.

A search of Mr. Hernandez’s person revealed multiple bags of what appeared to be cocaine and MDMA. Officers located a loaded handgun with no serial number in the vehicle. Mr. Hernandez does not a license to carry firearms.
