REPORT OF THE COMMITTEE ON RULES AND LEGISLATIVE AFFAIRS Upon the Communication of the City Manager transmitting informational communication relative to the proposed changes to the Rules of City Council: recommend adoption of the accompanying Order that City Council does hereby approve the attached proposed Rules of City Council as amended by the Standing Committee on Rules and Legislative Affairs.

Order - That the City Council of the City of Worcester hereby approves the minutes of the City Council Meeting of December 8, 2015.

In accordance with Rule 41 of the Rules of City Council, Mayor Joseph M. Petty requests reconsideration of the vote of City Council taken on December 15, 2015 to accept and adopt the Report of the Public Works Committee Upon the Communication of the City Manager transmitting communication relative to the Residential Resurfacing Program for FY17 and FY18.

Mayor Petty presented a Certificate of Recognition to Kayla Ruttan Cutter, an 11th grader at the Abby Kelly Foster School, who participated in a lifesaving action.

Attorney Donald J. O'Neil on behalf of Summer St. Hotel, LLC request to abandon, discontinue and remove from the Official Map the area of Washington Square containing approximately 75 square feet of land shown on the attached plan labeled "Discontinue Exhibit", dated 12/30/15 and prepared by Bohler Engineering.

Attorney Donald J. O'Neil on behalf of JNBB, LLC request to amend the Official Map to remove Hemans Court.

William S. Coleman, III request City Council have City Administration hold a Small Business Town Hall Workshop with a listening session for small businesses to air concerns and seek help from City Administration.

Michael J. Grandone request City of Worcester explore an ordinance and set regulations pertaining to panhandling.

Steven Dyer request sidewalk repair in front of 16 Monticello Dr.

Jo Hart request all items petitioned for public safety take precedence and change protocol to allow the full council to take up the item(s) on the spot and discuss them with the petitioner, rather that send them to various places where they will never surface to achieve true public safety, and that all such items be published as a Legal Notice in the Worcester Telegram so affected residents can be notified.

Todd Holland request the City Council Calendar available on the City Government web site provide the following: 1) Under description a full and accurate synopsis be placed to properly inform all citizens of the true & accurate purpose of said meeting. 2) Under the Heading of "More Information" a link is provided to available agenda and purpose of meeting. 3) All meeting minutes be available on line in a timely manor and to include accurate details on presenters, attendees and attachments of any proposed plans. 4) A more efficient format making it easier to navigate using a graphical user interface friendly to people who lack full computer literacy.

William S. Coleman III request City Council consider establishing a civic education program that teaches about our city government and how it works.

Todd Holland request all City of Worcester agendas include the name of the specific person(s) or department presenting on each item in a given agenda.

William S. Coleman, III request City Council hold a Citizen Town Hall Listening Session around the city, one in each district, with District Councilors welcoming residents to voice concerns for 2016.

Jo Hart request City Council request the City Manager invite Reverend Clyde Talley to an immediate and heavily publicized public hearing (not a Council committee) on the WRTA and how the City of Worcester can achieve both a new search for a new, overdue administrator to turn the failure of the WRTA into a functioning system.

Jo Hart request City Council request City Manager make the full-size list of WRTA schedule changes (now posted on a moving bus) to be immediately available at City Hall at the public information booth on the first floor, so bus riders can take one to understand these many changes.

Recommend that Eleven Thousand Eighty Eight Dollars And No Cents ($11,088.00) be transferred from Account #91C711D, Police Capital Rehab, to Account #25C702, Police Department Building Rehabilitation.

Recommend that a total of Eighty Six Thousand Six Hundred Twenty Six Dollars And No Cents ($86,626.59)be transferred from Account #91C711B ($33,837.37), Building Fire – Rehab, and Account #91C7114 ($52,789.22), City Building Rehabilitation, to Account #26C704, Worcester Fire Department Capital Rehabilitation,

Recommend that Six Thousand Five Hundred Fifty Four Dollars And Seventy Five Cents ($6,554.75) be transferred from Loan Account #91C7804, Capital Equipment, and be appropriated to DPW Account #41C703, Capital Equipment, when and as received, to allow for the purchase and future payment of one (1) Bobcat 225 and Quick Connector.

I respectfully recommend that Four Hundred Twenty Thousand Dollars and No Cents ($420,000.00) be transferred from Account #75C504, DCU Special District, and appropriated to Account #75C705, DCU Enhancement, for construction costs associated with retail space.

Recommend that Fifty Thousand Dollars And No Cents ($50,000.00) be transferred from Loan Account # 91C784AI, Open Space, and be appropriated to Parks Account #72C70240, Open Space, to allow for current and anticipated contractual obligations for Open Space plans for the proposed dog park.

Recommend that Sixty Five Thousand Dollars And No Cents ($65,000.00) be transferred from Loan Account #91C7112A, and be appropriated to Account #41C704, Building Rehabilitation, to allow for the payment of current and anticipated obligations for these much needed building repairs.

Recommend that One Hundred Fifty Four Thousand Dollars And No Cents ($154,000.00) be transferred from Account #91C7111A, City Rehab Building and School, and be appropriated to Account #04C754, City Wide School Energy Improvements, to allow for payment of current and future obligations.

Recommend that the City Council accept with gratitude a donation in the amount of Four Thousand Dollars and No Cents ($4,000.00) from the Harrington Foundation to the Worcester Public Library's Librarian's Trust Fund.

Recommend that the City Council accept with gratitude a donation of four (4) thermal imaging cameras with a total value of Thirty Six Thousand Seven Hundred Twenty Five Dollars and No Cents ($36,725.00) from the Leary Firefighters Foundation to the Worcester Fire Department.

Recommend that the City Council accept with gratitude numerous small donations to the Worcester Public Library for the 2nd quarter of FY16 in a total amount of Seventy-Five Dollars and No Cents ($75.00).

Recommend approval of a resolution to file and accept grant applications in total not to exceed Two Million Dollars and No Cents ($2,000,000.00) from the US Department of Homeland Security's FY 2015 Assistance to Firefighters Grant program.

Recommend that the City Council accept with gratitude a donation from the Massachusetts Port Authority in the amount of Ten Thousand Dollars and No Cents ($10,000) for improvements at the Commerce Bank Field at Foley Stadium.

Recommend acceptance of a resolution to file and accept a grant in the amount of Eight Thousand Dollars And No Cents ($8,000.00) from the Massachusetts Association of Health Boards to support Community Health Improvement Plan activities.

Recommend that Fifty Seven Thousand Eight Hundred Sixty Eight Dollars And Ninety Nine Cents ($57,868.99) be transferred from Account #310-92000, Worcester Jobs Fund Ordinary Maintenance, and be appropriated to various accounts, to fund the Worcester Jobs fund program through June 30, 2016

Recommend that Thirty Thousand Six Hundred Eighty Five Dollars And Twenty Seven Cents ($30,685.27) be transferred from the following accounts: $10,000.00 from Account #162-96000, Non-Contributory Pensions, and $20,685.27 from Account #900-92000, Contingency, and appropriated to Account # 161-96000, Contributory Pensions, for Military Service appropriation for 2013 & 2014.

FROM THE COMMITTEE ON MUNICIPAL OPERATIONS - Request City Council consider initiating negotiations with the current City Manager for an employment contract extension for the period October 4, 2017 through October 3, 2020.

FROM THE COMMITTEE ON TRAFFIC AND PARKING - Request City Manager provide City Council with the accident statistics that have occurred in the last two (2) years for Gold Star Blvd. and West Boylston St. due to vehicles driving in the wrong direction.

Request City Manager provide City Council with a report detailing the number and type of motor vehicle accidents reported at the intersection of Grove and Chester Streets for the past two calendar years. (Gaffney)

Request City Manager provide City Council with an updated Master Plan for the Higgins Industrial Park that transitions past usages of these properties to future market demands. (Economou)

Request the City Manager report to the City Council as to whether or not the process used by the Department of Public Works to determine the extent of the city's response to both minor and major winter storms needs improvement including information concerning the amount of staff people and equipment for plowing, sanding, salting and inspecting. (Rosen)

Request City Manager report to City Council regarding the legality and acceptability of Worcester homeowners paving their front lawn for parking or of homeowners simply parking vehicles on that grass. (Rosen)

Request the Chief of Police consider installing a live advisory speeding detail and enforcement detail in Aylesbury Road on school days for traffic travelling downhill towards Flagg Street School. (Rosen)

Request City Manager report to City Council concerning plans, if any, by the City to have police officers wear body cameras while on duty. (Rosen)

Request City Manager request the Commissioner of the Department of Public Works and Parks provide the City Council with an analysis of brightness of street lights in Wachusett St. in the area of Dix, Home and John Streets. (Rivera)

Request City Manager provide City Council with a list of city-owned buildings/facilities and the names of all tenants who occupy them. The list should include whether the tenants are for-profit or not-for-profit organizations and the amount of rent that each is paying to the city. (Rosen)

Request City Manager provide City Council with an update concerning discussions, if any, between the city and the relocating Pawtucket Red Sox. (Rosen)

Request City Manager request the Commissioner of the Department of Public Works & Parks provide the Public Works Committee with a report for consideration at the February 24th meeting as to the amount of revenue produced each year by the sewer connection fees. Further request that the report include information as a separate item those fees collected for change of use applications where no new connection was made but fees were imposed. (Russell)

Request City Manager request the Commissioner of the Department of Public Works & Parks provide the Public Works Committee with a report for consideration at the February 24th meeting showing the amount and types of permits applied for each year since connection fees have been charged in recent years. Request City Manager request the Commissioner of the Department of Public Works & Parks provide the Public Works Committee with a report for consideration at the February meeting revealing the amounts and how the sewer connection fee revenue is used in the DPWP budget. (Russell)

Request City Manager provide City Council with feedback concerning those communities that have raised to 21 years of age the minimum age to purchase tobacco products. (Rivera)

Request City Council recommit the report of the Standing Committee on Rules and Legislative Affairs voted on December 28, 2015 regarding review of the City Council's rules for further discussion as two of the committee's members(out of a total membership of three members) were not able to be present at the meeting. Request City Manager consider not raising property taxes on residents and businesses with the next budget. However, if the manager's budget includes a tax increase, it be prescribed that each and every dollar of the increased tax revenue be used to fund the City's pension and OPEB liabilities to protect the City's financial standing and fulfill the City's obligations. Alternatively, that the increased revenue be used to fund a police and fire class with the remainder be used to fund the City's pension and OPEB liabilities. (Gaffney)
