Presentation of a Resolution to Park Spirit for their donation of $3,000.00 to benefit the Department of Public Works & Parks, Parks, Recreation & Cemetery Division Summer Recreation Programs.

Mayor Lukes read a proclamation declaring September 2007 Infant Mortality Awareness Month and it was presented to George Michael Protouphy who spoke on behalf of Dr. Marianne Felice, Chair of Pediatrics and UMass and Chair of the Infant Mortality Reduction Task Force.

Robert Chipman et al request to make public Balis Ave. from end of public portion at 35 Balis Ave. approximately 60' to end.

Scott Cashman, Vice Chairman of the Worcester Planning Board on behalf of the Worcester Planning Board respectfully recommends the following Zoning Ordinance amendment: That Article IV, Table 4.2-Permitted Dimensions by District, regarding Single-Family, Semi-detached dwellings in RS-10 and RS-7 zones be deleted". This amendment reflects City Council's policy intent and is internally consistent with City Council’s amendment to prohibit this use in RS-7 and RS-10 zones.

Scott Cashman, Vice Chairman of the Worcester Planning Board on behalf of the Worcester Planning Board respectfully recommends the following Zoning Ordinance amendment: " That Article IV, Section 6(4), last sentence regarding illuminated or motion signs be deleted from the Zoning Ordinance". This amendment reflects City Council's policy intent and is internally consistent with City Council's recent amendment to Table 4.3 that prohibits this type of sign in Business Limited (BL-1) districts.

Scott Cashman, Vice Chairman of the Worcester Planning Board on behalf of Worcester Planning Board respectfully recommends that the Zoning Ordinance be amended to correct an inadvertent omission in Article XV-Adaptive Reuse Overlay Districts by inserting the following and re-lettering accordingly: "B. In addition, the Planning Board, by special Permit, shall have the authority to waive or modify dimensional controls set forth in Table 4.2 of this Ordinance."

Recommend City Council Approval of the Following Transfers which were Executed in Order to Balance all City Accounts Prior to the Final Close-Out of Fiscal Year 2007.

FROM THE COMMITTEE ON HEALTH - Request City Manager request the City Solicitor to provide City Council with an opinion whether or not residential tenants have rights to require their landlords to install a radon remediation system if the levels of radon are found to exceed adaptable levels as a result of testing brought about by the proper installation and operation of testing equipment provided through programs offered by the Massachusetts or City of Worcester Departments of Public Health.

FROM THE COMMITTEE ON HEALTH - Request City Manager inform the City Council whether or not all buildings under the City's ownership and jurisdiction have been tested to determine radon levels.

FROM THE COMMITTEE ON HEALTH - Request City Manager provide City Council with a copy of the federal mandate that testing be conducted to determine radon levels in public school buildings.

FROM THE COMMITTEE ON HEALTH - Request City Manager work with our local legislative delegation to bring about state legislation that would require that routine radon testing be performed whenever real estate ownership transfers containing residential unit(s) take place.

FROM THE COMMITTEE ON PUBLIC SERVICE AND TRANSPORTATION - Request City Manager begin planning for a follow up Climate Action Plan for the period 2010 and afterwards.

FROM THE COMMITTEE ON PUBLIC SERVICE AND TRANSPORTATION - Request City Manager provide City Council with an Executive Summary of the 3rd report of the Intergovernmental Panel on Climate Change Goals.

FROM THE COMMITTEE ON PUBLIC WORKS - Request the License Commission to consider placing a condition on the parking lot license for the College of the Holy Cross such that the gate at the terminus of City View Street only be opened for emergency access and egress.

FROM THE COMMITTEE ON PUBLIC WORKS - Request City Manager recommend to the City Council an increase in the capital expenditure necessary to carry out the necessary repairs to Franklin St. in the vicinity of Putnam Lane.

Request City Manager request the Commissioner of Health and Human Services review the existing state laws and local ordinances pertaining to keeping boats, trailers, campers and large trucks in the public ways and on privately owned property in residential districts and recommend law or regulatory changes to the City Council prior to October 1, 2007 to provide for a better quality of life in our neighborhoods. Request City Manager provide City Council with information regarding the provisions of Section 19 of Chapter 32(b) of the Massachusetts General Laws, which, if adopted, allows cities and towns to establish a coalition bargaining system for health insurance benefits. Request City Manager provide City Council with a report concerning the health of the retention/detention pond at 39 First Street in light of the several concerns raised recently by residents of this housing complex as to the deteriorating water quality and odor. (Rushton, Petty)

Request City Manager request the Traffic Engineer review the traffic flow and signage at the egress of the newly constructed Ascension Elderly Apartments on Vernon Street in order to maximize motorist safety. (Clancy)

Request City Manager consider reassigning a position within Executive Office of Neighborhood Services as a Neighborhood Liaison to reconnect the Neighborhoods with City Hall. (Perotto)

Request City Manager provide City Council with a report concerning the grass conditions in fields at East Park and Beaver Brook Park. (Perotto)

Request City Manager to provide a copy of the Mayor’s Social Service Task Force Report from October 2005 to all identifiable service providers who site community care programs in the City and all identifiable funding agencies for these programs - including banks and foundations - with a letter of request that they meet with the City Administration to discuss the recommendations. Request City Manager to provide City Council with a report concerning the recently sited social service program, Unlocking Potentials for Growth, Inc., at 8-10 Stoneland Road, to include whether or not the program will operate under protection of the Dover Amendment, whether it will require a lodging house license, and if it meets all appropriate permitting and zoning ordinance regulations. Further, request that the report state the maximum number of residents possible and that the report include information regarding the target population; whether it will serve registered sex offenders and/or violent offenders and/or arsonists; their expected length of stay; requirements for maintaining residency; and recidivism expectations. Request City Manager provide a tactical improvement plan to improve the quality of streets and sidewalks by paving 21 miles each year, the amount of miles that the Commissioner of Public Works & Parks has stated the city should pave in order to maintain the Worcester meet industry-recommended standards, and an amount that is significantly more than the 13 miles of streets and sidewalks that we have repaved/repaired annually over the past decade, resulting in the deplorable condition of this most visible and necessary part of our infrastructure. Request City Manager consider adopting a policy so that monies authorized for street and sidewalk repair be used for such purposes within a six month time period from date of authorization by City Council. Such purpose is to get our city roadways and sidewalks repaired within the construction season and to avoid to a 3 to 5% increase in total cost. (Rushton)
