Worcester, MA, October 5, 2017- On Thursday, October 5, 2017, at approximately 2:20 AM, Worcester Police responded to 118 Highland Street for a reported armed robbery that just occurred outside of 58 Fruit Street. Responding officers were asked to meet the victim in the parking lot of the Sole Proprietor.
The victim stated that he arrived at the Fruit Street address, exited his vehicle and approached the male that was sitting on the front ledge of 58 fruit Street. The victim asked the male if he had ordered the food. The male suspect stated that he was the one that ordered the food. At this time the victim noticed that the suspect was holding a paper bag that had the outline of a handgun. Although the victim stated that he did not see the actual gun, the suspect was holding it in a threatening manner and that whatever was in the bag was shaped just like what a gun would look like. The victim stated that he was in fear that a gun was inside the bag. According to the victim, the suspect was described as approximately 5’5” tall, thin build, wearing all dark clothing and holding a paper bag that he believed contained a handgun.
At this time the victim handed the suspect the food and walked back towards his car and drove off. The victim noticed in his rear view mirror that the suspect was walking towards the rear of 60 Fruit Street.
Officers at the scene were able to trace the phone number provided during the initial food order and cross reference the address at 60 fruit Street to the phone. Officers knocked on the door. A male identified as Joseph Czubek, 59-years-old of the Fruit Street address answered the door. Officers asked Mr. Czubek if anyone else was inside the studio apartment. The officers were told that there was no one else inside. Due to this incident involving a potential gun, the officers asked if they could do a protective sweep of the apartment. Mr. Czubek allowed the officers to check the apartment for themselves. A quick search located a male identified as Christopher Durham, 23-years-old of 35 Cavour Circle, West Boylston. Mr. Durham was found hiding under a jacket in the corner of a closet. Mr. Durham fit the description of the suspect that was provided by the victim. Inside the apartment police recovered the stolen food and the matching order number that was with the food while the copy was with the victim. The search did not locate a weapon.
Mr. Durham was placed under arrest and charged with Armed Robbery. Mr. Czubek was placed under arrest and charged with Misleading a Police Investigation.
Both men were arraigned today at the Worcester County District Courthouse.
