ELECTION OF TWO RESIDENTS TO THE LIBRARY BOARD OF DIRECTORS

8a.

ELECTION - To fill two (2) vacancies for terms ending December 31, 2028.

Mayor Petty read the item and provided an opening statement, including information from, “Rules Appendix D – Election of the Library Board,” from the Rules of City Council, which outlines the process for electing members of the Library Board of Directors. Mayor Petty recognized Christina Andrianopoulos, Katie Chappell, Tina Sullivan, Moses Zenon-Laguerre and Fatou Niang, who spoke relative to their qualifications to be elected to the Library Board of Directors. Mayor Petty moved for a roll call vote to elect two members for the terms ending on December 31, 2028. Christina Andrianopoulos, having received the most votes and a majority vote of City Council, was elected on the first roll call for the first term ending on December 31, 2028. Mayor Petty moved for a roll call vote to elect one member for the remaining term ending on December 31, 2028. Moses Zenon-Laguerre, having received the most votes and a majority vote of City Council, was elected on the second roll call for the second term ending on December 31, 2028.

EXECUTIVE SESSION

9a.

That the City Council of the City of Worcester convene in Executive Session at its December 6, 2022 meeting for the purpose of negotiating a contract of about two (2) years, subject to negotiation, appointing Eric D. Batista as the city’s permanent City Manager. The City Council will reconvene in Open Session at the conclusion of its negotiations.

City Council reconvened into Open Session at 9:06 P.M. Mayor Petty read the following Order into the minutes of City Council pertaining to the negotiations with Eric D. Batista as the city’s next permanent City Manager: “Whereas, on November 15, 2022, the City Council voted to appoint Eric D. Batista as the next permanent City Manager of the City of Worcester; and Whereas, the City Council and Mr. Batista have agreed to the terms of the attached employment agreement; Now Therefore, Be It Ordered that Mr. Batista’s appointment shall be effective December 6, 2022, upon execution of the attached unemployment agreement; and, Be It further Ordered that the Mayor Joseph M. Petty, be and is hereby authorized on behalf of the City Council of the City of Worcester to execute the employment contract with Mr. Batista pursuant to Section 3-1(b) of the Charter and M.G.L. c.41 §108N.” (See attached). A summary of employment agreement terms reads as follows: 1. Approximately a two-year term, commencing upon execution and ending on December 31, 2024. 2. City Council to provide notice of intent to negotiate a subsequent agreement by June 20, 2024. 3. Salary - $270,000.00 4. Effective December 6, 2023 – 3% cost of living increase, or such lesser percentage reflective of the highest percentage increase awarded to any city bargaining unit. 5. 5 weeks vacation leave 6. Payment of $3,750.00 towards, each, the cost of disability insurance and the cost of life insurance 7. On January 6 of year, city will make a payment equal to the maximum allowed under IRS regulations towards a deferred compensation plan 8. The city will provide the use of a city-owned vehicle 9. Six month severance benefit if removed from office Mayor Petty moved for a roll call vote to adopt the Order. Order adopted on a roll call vote of 11 Yeas and 0 Nays. Mayor Petty recognized Councilor King, who moved for reconsideration on the item. Reconsideration denied on a roll call vote of 0 Yeas and 11 Nays. Mayor Petty read the following proposed Ordinance into the minutes of City Council pertaining to the negotiations with Eric D. Batista as the city’s next permanent City Manager: “AN ORDINANCE AMENDING THE SALARY ORDINANCE RELATIVE TO THE SALARY OF THE CITY MANAGER Be it ordained by the City Council of the city of Worcester as follows: Section 1. Notwithstanding any other provision to the contrary, the salary of the city manager is hereby established at Two Hundred Seventy-Five Dollars and no cents ($275,000.00). Section 2. This ordinance, upon adoption, shall be deemed effective as of December 6, 2022. Section 3. All prior ordinances establishing the salary of the city manager are hereby repealed.” (See attached). Mayor Petty moved for a roll call vote to advertise the proposed Ordinance. Voted to advertise proposed Ordinance on a roll call vote of 11 Yeas and 0 Nays. Mayor Petty then executed the attached contract and performed a ceremonial swearing in to appoint Eric D. Batista as the city’s City Manager.

REPORT OF THE PLANNING BOARD Upon the Petition of Paul Conger request Article XV, Section 5 of the Worcester Zoning Ordinance be amended to allow the Planning Board to modify certain zoning requirements by special permit for new Multi-Family Dwelling buildings within the Adaptive Reuse Overlay District by deleting Subsection D in its entirety and inserting in lieu thereof the following: “D. In addition, notwithstanding anything to the contrary contained in Article IV, Section-7, the Planning Board shall be authorized to grant a special permit to modify parking, loading requirements, dimensional requirements for off-street parking and loading areas; landscaping requirements; intensity of use buffer area requirements; layout requirements and number of required spaces for uses permitted in Adaptive Reuse Overlay District (by right or by special permit) pursuant to Section-3 of this Article. This provision shall only apply to Multi-Family Dwelling (low-rise and high-rise) uses (new or existing) and uses in the Adaptive Reuse Overlay District which are located in buildings or structures in existence as of October 22, 2022. Per Article IV, Table 4.4 Notes, the required number of spaces cannot be reduced below (1) space per dwelling unit.”

Subject to Subsection 5(C) of this Article XV, for all new buildings and structures, the parking requirements of Table 4.4 of this Ordinance shall apply.” “C. For reuse or substantial restoration of existing buildings or structures within the Adaptive Reuse Overlay District and new Multi-Family Dwelling buildings (low-rise and high-rise), the parking requirements of Table 4.4 of this Ordinance shall apply with the following exceptions: 1. All residential parking shall require 1.5 parking spaces for each dwelling unit; and 2. Office, professional/general uses shall require one (1) parking space for every 500 square feet of gross floor area.”
