ORDER of Mayor Joseph M. Petty - That City Council does hereby accepts MGL 44B sections 3 to 7 relative the Community Preservation Act. Further, That Consistent with 7-11 of the Worcester Home Rule Charter, the City Council does hereby place before the voters at the November 6, 2018 state election the following binding question: Shall Worcester accept sections 3 to 7 inclusive of Chapter 44B of the General Laws, as approved by the City Council a summary of which appears below?

Mayor Petty moved to amend the Order to read as follows: The City Council hereby votes to approve and accept section 3 to 7, inclusive, of the Community Preservation Act, M.G.L. Chapter 44B, by approving a surcharge on real property of 1.5% of the annual real estate tax levy against real property commencing in fiscal year 2020 and; further, by accepting the following exemption as authorized by section 3(e) of said Act: (1) for property owned and occupied as a domicile by a person who would qualify for low income housing or low or moderate income senior housing in the city of Worcester; (2) fir $100,000 of the value of each taxable parcel of residential real property and; (3) for the $100,000 of the value of each taxable parcel of class three, commercial property, and class four, industrial property as defined in section 2A of said Chapter 59; provided further that the approval and acceptance of sections 3 to 7 if the Act on the foregoing terms and conditions shall appear as a ballot question at the November 6, 2018 state election ballot within the city of Worcester and shall not take effect within the city of Worcester and shall not take effect unless a majority of voters voting on said question vote in the affirmative. Order denied as amended on a roll call vote of 5 Yeas and 6 Nays (Yeas - King, Rivera, Rose, Toomey, Petty) (Nays - Bergman, Lukes, Mero-Carlson, Rosen, Russell, Wally). Councilor Lukes moved for reconsideration on the Item. Reconsideration denied on a roll call vote of 0 Yeas and 11 Nays.

ORDER of Councilor Morris A. Bergman and Councilor Gary Rosen - Request the Worcester Board of Health consider put on hold implementation of its April 23, 2018 vote restricting the sale of such products to adult-only establishments. While the Worcester City Council supports efforts to curb the use of flavored tobacco products by our youth, the Board of Health’s well intentioned previous action will do little to stop youth under the age of 21 from purchasing and/or using these products. Further, Request City Manager request the Commissioner of Public Health, the Board of Health, and the New England Convenience Store & Energy Marketers Association, which represents 266 Worcester small business owners, meet to discuss alternative ways (such as prohibiting the open display of such products) to deter city youth under the age of 21 from purchasing and consuming these products.
