TAX CLASSIFICATION HEARING - 7:30 P.M.

To determine tax rates for residential, commercial, industrial and personal properties for Fiscal Year 2013.

Mayor Petty opened the Tax Classification Hearing @ 7:35 P.M. and the following people appeared and spoke: 1. Richard Kennedy, Worcester resident 2. Gary Vecchio, Worcester resident 3. Leonard Zalauskas, Worcester resident The Mayor closed the public speaking portion of the hearing and heard Councilors input. Mayor Petty moved to recommend for consideration Line 185 – That the tax rate for Fiscal Year 2013 be set at $18.58 for Residential Property tax and $30.85 for Commercial, Industrial and Personal property. Councilor Lukes moved to recommend for consideration Line 216 – That the tax rate for Fiscal Year 2013 be set at $18.16 for Residential Property tax and $31.91 for Commercial, Industrial and Personal property. Councilor Russell moved to recommend for consideration Line 239 – That the tax rate for Fiscal Year 2013 be set at $17.86 for Residential Property tax and $32.69 for Commercial, Industrial and Personal property. City Manager submitted Supplemental #1(see item #24a CC) for consideration. Mayor Petty took up items #12a, 12b, 12c, and supplemental #1 for discussion. Councilor Rivera made a motion - see item #24b CC. Councilor Lukes made two motions - see items #24c & 24d CC. Mayor Petty made a motion as amended by Councilor Lukes - see item #24e CC. Councilor Germain made a motion see item #24f CC. Councilor Economou moved to take up item #11k CC. Councilor O’Brien moved to Hold Under Privilege items 11k, 12a, 12b, 12c, supplemental #1, and recess the Tax Classification Hearing to December 11, 2012. Councilor Rushton moved – That the City Council of the City of Worcester does hereby request the CFO for the Worcester Public Schools be present for the reconvened Tax Classification Hearing on December 11, 2012. Councilor Toomey moved to request City Council to support requesting the state legislature to fund the McKinney-Vento Act in full since the obligation to the federal law has not changed. Mayor Petty moved for a 5 minute recess – Approved on a voice vote Recessed: 8:55 P.M. Reconvened: 9:23 P.M. That the City Council of Worcester hereby resolves that it is opposed to the siting of any medical marijuana dispensing entity within the City of Worcester and that the City Council opposes the implementation of any Massachusetts legislation authorizing the dispensation or production of medical marijuana until the matter is resolved by federal legislation. REPORT OF THE COMMITTEE ON MUNICIPAL OPERATIONS Upon the Order of Mayor Joseph Petty, Councilor Tony Economou, Councilor Michael J. Germain, Councilor William J. Eddy - Request the Standing Committee on Municipal Operations conduct at least one public hearing to consider the following proposed changes to the regulations and rules governing livery companies and livery drivers: 1) that livery companies must own and control licenses for livery drivers and that drivers will only be able to have a livery driver's license if they are employed by a livery company, and 2) that drivers who own and operate their own cars, which are licensed livery vehicles, can only operate as liveries if affiliated with a livery company, and 3) that regulations continue to reflect the 2-hour regulations, and 4) that livery companies be required to maintain a physical office with log books and pertinent records, and 5) that a special work order be drafted by the City which livery drivers can produce when required to do so while waiting to pick up customers who have previously placed a pick-up reservation with a livery company at Union Station or the Airport, and 6) that the number of livery car licenses be capped at the current level, and 7) that regulation and oversight for livery cars and drivers be placed under the jurisdiction of the License Commission: recommend adoption of the accompanying Order to request City Manager request the City Solicitor incorporated the above changes to the rules, regulations and/or Ordinances relative to Livery Companies and Livery Drivers for consideration by the full City Council and further, that these amendments be in effect for a 90 day trial from the date of enactment by City Council.

O'Brien Request City Manager consider working with the Worcester Public Schools to employ a consultant to study the feasibility of repairing and restoring to use the Olympic-sized swimming pool at South High Community School. Further, request that they consider encouraging various uses including Learn-to-Swim programs throughout the year, lifeguard training, additions to the Summertime Wheels-to-Water program and other year-round aquatic activities. Lastly, request that they work with the Mayor and the Standing Committee on Youth, Parks and Recreation to form a committee to work with philanthropic entities and individuals to help defray the costs of such repairs and programming if the City of Worcester capital budget cannot accommodate these improvements: recommend this Order be amended to request the Superintendent of Public Schools provide a report to the City Council concerning the feasibility of restoring the swimming pool at South High Community School and the amended Order be referred to the School Committee.
